Below is a detailed description of the process of issuing a power of attorney for a lawyer in Turkey.
A power of attorney is a written document issued by one person to another for representation before third parties.
In order to issue a power of attorney for a representative in Turkey, without leaving your country, you must contact the nearest Turkish Consulate or a notary at your location.
On the power of attorney issued by a notary, it is necessary to put the stamp “Apostille”.
Important! Powers of attorney to some transactions with real estate in Turkey and divorce must be mandatory with a photo of the principal.
Such a power of attorney can only be made at the Turkish Consulate, while notaries do not issue a power of attorney of this format, but we recommend that you clarify the possibility of drawing up this type of power of attorney at your location.
For other powers of attorney (for the representation of interests, company registration, any legal procedures, except for divorce), a photo is not required, so they can be done at any notary.
The process for obtaining a power of attorney is as follows:
-You receive the text of the power of attorney (sample) from the Turkish representative.
-According to this text, a power of attorney is drawn up at the notary in the country of your residence. In the power of attorney, you must specify the data of your international passport, as well as the data of the lawyer for whom the power of attorney will be issued.
-Then put down the Apostille stamp on the original power of attorney in the Ministry of Justice of the region where it was issued.
-We recommend to translate an apostilled power of attorney from your language into Turkish in Turkey with a local sworn translator. This can be done by the host.
