Legal assistance for consumer matters in Turkey
Consumer rights are an important part of generally recognized human rights, and their protection is one of the key areas of public policy. Despite this, the number of litigation in this area remains high, which indicates a significant demand for effective consumer protection.
How are disputes arising from contracts for the sale of goods resolved?
One of the most common reasons consumers go to court is disputes related to goods of inadequate quality. For example, if a technically complex product turns out to have a manufacturing defect discovered after 15 days from the date of delivery of the product, the buyer has the right to demand a refund or replacement, but only if the defect is significant.
It is important to note that the powers of organizations or individual entrepreneurs to satisfy consumer demands regarding goods of inadequate quality must be stipulated in the agreement with the manufacturer or seller.
However, costs for the services of representatives (for example, a consumer protection society) are not considered legal costs necessary for access to justice, and therefore they are not subject to compensation in court. p>

How to write a statement of claim for consumer protection?
The statement of claim must contain the following information:
- Name of the courtwhere the application is filed.
- Name of the plaintiff, his residential address. If the plaintiff is an organization, then its name and address.
- Name of the defendant, his residential address or, if it is an organization, its location.
- A specific description of the violation of rights, threat of violation, or legitimate interests of the plaintiff.
- Plaintiff's claims.
- Circumstances and evidenceon which the plaintiff bases his claims.
- The price of the claim (if it is subject to assessment) and the calculation of the amounts of money to be recovered.
- Information on compliance with the pre-trial dispute resolution procedure (if required).
- List of attachments to the statement of claim.
It is also recommended to indicate contact information (phone, email) and additional requests that may be useful when considering the case.
Which court should I go to for consumer protection?
The consumer has the right to independently choose the most convenient court to file a claim. You can file a claim:
- At the location of the defendant (for example, the seller or manufacturer).
- At the consumer’s place of residence or stay.
- At the place of conclusion or execution of the contract.
- At the location of the seller’s branch or representative office.
This flexibility allows the consumer to minimize the inconvenience of filing a claim.
