A client contacted our law firm after breaking up with a young man, a Turkish citizen, with whom she had been in a relationship for a year.

During their relationship, the man showed attention, gave gifts and transferred funds to the client’s account as financial support. However, after a series of quarrels, the relationship ended, which caused an aggressive reaction in the man and unwillingness to come to terms with the separation.

After the breakup, the client began receiving threats from her ex-partner. He followed her, took photographs, and sent them along with threats. Despite the lack of response to the client's threats, the man attempted to intimidate her, believing that, as a foreigner in a foreign country, she would not be able to defend her rights. He contacted the executive service with an application to open a trial, as a result of which the client received notification of the commencement of the proceedings.

Our actions:

1. We conducted a thorough analysis of the situation and collected the necessary evidence, including verification of bank transfers.

2. It turned out that all the transfers were made without indicating the purpose of the payment (according to Turkish law, it is listed as gifts or repayment of debt), which indicated the absence of any legal grounds for claims on the part of the man.

3. We filed a counterclaim, as a result of which the trial was suspended.

4. In order to protect the client, we contacted law enforcement agencies and obtained a temporary ban on approaching (uzaklaştırma) for a period of 1 month with the possibility of extension. If the ban was violated, the man faced imprisonment.

After our actions, the client’s former partner contacted us with a request to stop the entire process. Subsequently, there was no contact between them and all proceedings were completed.

Result:

This case demonstrates the importance of seeking legal assistance in a timely manner and defending your rights. In Turkey, as in any other legal system, foreign citizens have every right to protection, including from threats and persecution.
