For what violations are foreigners deported from Turkey?

In accordance with the Turkish Law on International Protection and Foreigners, Article 54, a foreign citizen can be deported from the country in the following cases:

  1. Committing a crime punishable by deportation.
  2. Participation in a terrorist or criminal organization. This applies to leaders, members or supporters of such organizations, including those who profit from them.
  3. Use of false documents. This includes submitting false documents when entering Turkey, applying for a visa or residence permit.
  4. Illegal receipt of funds.
  5. Threat to public order, safety or public health.
  6. Violation of the visa regime. This includes staying in the country with an expired visa or visa-free entry for more than 10 days, as well as visa cancellation.
  7. Cancellation of a residence permit.
  8. Work without permission.
  9. Violation of entry or exit rules.
  10. Attempted entry despite a travel ban from Turkey.
  11. Rejection of an application for international protection.This applies to cases where the application for renewal of international protection status or residence permit is rejected and the person does not leave Turkey within the prescribed period (usually 10 days).
  12. Stay after refusal to renew a residence permit.

Who is exempt from deportation?

Certain categories of aliens are protected from deportation even if they fall under the provisions of Article 54:

  • Persons who may face the death penalty, torture, inhuman or degrading treatment in the country of deportation.
  • Persons whose health, age or pregnancy make deportation impossible or life-threatening.
  • Persons with life-threatening diseases, if the country of deportation does not have conditions for continuing their treatment.
  • Victims of human trafficking in protection programs.
  • Survivors of physical, psychological or sexual violence before completing treatment.

If these circumstances are eliminated, a decision on deportation may be made.

How to challenge a deportation decision?

A foreigner has the right to appeal the deportation decision. The claim can be filed with the administrative court within 7 days from the date of notification of deportation. Sometimes deportation is not carried out until the completion of the judicial proceedings, except in cases related to terrorism, a threat to public order or the refusal of an application for international protection.
