What debt collection methods exist in Turkey?
In Turkey, there are two main ways to collect debts from individuals and legal entities:
- Judicial procedure – within the framework of which a court decision is executed through executive bodies.
- Administrative procedure is a faster and more simplified process that is used in cases where there is a contract or obligations that do not require lengthy legal proceedings.
Important points:
- If there is no treaty on mutual legal assistance between Turkey and the plaintiff's country, the plaintiff must pay a security deposit for foreign individuals and legal entities intending to initiate litigation in Turkey.
How much is the security deposit?
Turkish law does not establish a fixed amount for the security deposit. In practice, it amounts to 15-25% of the amount of the claim. This deposit is required to cover legal costs and possible costs associated with the process. If the court makes a positive decision in favor of the plaintiff, the deposit is returned.
What debts can be recovered in Turkey?
The following types of debts can be recovered in Turkey:
- Loan debt, including car loans and mortgages.
- Non-payment of taxes, penalties and finesby both individuals and legal entities, including companies registered in Turkey.
- Debts under receipts, contracts and other obligations.
How do our debt collection lawyers work in Turkey?
- Consultation. The lawyer will review your situation/documents and offer possible options for resolving the case.
- Pre-trial settlement. After agreeing on a work strategy, the lawyer can contact the debtor to resolve the issue without going to court. If necessary, a notification is sent about the required payment and established deadlines through judicial mediation or through the Executive Bodies.
- Litigation. If the debtor does not comply with the requirements, after agreement with you, the lawyer files a statement of claim with the court.
- Enforcement proceedings. After a court decision is made in your favor, the case may be transferred to the Executive Authorities for forced collection of the debt. This may include seizure of the debtor's property or other measures to enforce a court decision.
